WHY ATTEND?

Markets for Information and Communications Technologies (ICT) are convergent and increasingly complex. In this context, Standardization is a key factor in enhancing market growth and widening consumer choice, as it enables manufacturers to achieve greater interoperability and to develop technologies around transparent and accepted principles.

Although standardization is a cornerstone in the development of ICT markets, there is scope for conflict between Standards and Intellectual Property Rights (IPRs), and especially patents. The proprietary and exclusive nature of IPRs contradicts with the intended wide adoption and collective use of a standard. This tension is inevitably leads to conflict, wherever the technical content of a Standard falls within the scope of a patent, as defined by its claims.

This Symposium was an opportunity to discuss this relationship between Standards and IPRs and to scrutinize the new exciting and significant legal developments in that fast evolving field on the intersection between Intellectual Property and Competition law.

  • The challenge for Standards Developing Organizations (SDOs) to reduce the inherent tension between IPRs and  Standards by striking the proper balance between all the interests involved
