Dr. Zhang Xiang Chen, Director General, Department for WTO Affairs, Ministry of Commerce of the People's Republic of China (MOFCOM)

Dr. Zhang Xiang Chen is head of the WTO Department of the Chinese Ministry of Commerce and Director General of China's WTO Notification and Enquiry Centre. He holds a Doctor of Law from Beijing University and was a senior visiting scholar in the International Relations Institute of John Hopkins University in 202. From 1992 to December 2001, Dr. Zhang Xiang Chen was involved in the negotiations to resume the contracting party status in GATT and enter the WTO. His main writings include 'Political and Economic Relations between developing Countries and WTO' and 'Sino-American Relations after China's Entry into WTO'.

Dr. An Baisheng, Deputy Division Chief, Department for WTO Affairs, Ministry of Commerce of the People's Republic of China (MOFCOM)

An Baisheng is a WTO trade negotiator and researcher at the Chinese Ministry of Commerce (MOFCOM) where he is responsible for WTO/TBT related issues. His current work focuses on Chinese compliance with WTO Intellectual Property Rights Issues in Standardization (G/TBT/W/251 and G/TBT/W/251. Add. 1). Before coming to MOFCOM in 2002, he had worked for Chinese standardization authority, General Administration for Quality Supervision, Inspection and Quarantine (AQSIQ), where he was responsible for policy research on Chinese international standardization competition strategies.
Dr. An received his Ph.D. in economics in 2004 from the School of Economics of China Renmin University. He has published a book on the economics of standardization as well as academic articles exploring the intersection of intellecxitual property rights and anti-monopoly. He has given speeches at domestic and international seminars on IPR and standardization, including the 2005 Standardization and Law Seminar at Stanford University, the 2005 APEC High Level Seminar on Intellectual Property Rights, and the 2007 Open Standards International Seminar at Yale University.



Kent Baker - QualcommKent BAKER, V.P., Director of Global Intellectual Property Rights (IPR) Policy and Compliance Division for QUALCOMM Incorporated.

Qualcomm is an internationally recognized leader in wireless telecommunications and multimedia services. Mr. Baker holds advanced degrees in engineering, law, business, and has a certificate in metallurgical engineering. His division is active in regulatory, standardization, trade, and related IPR issues. 

Mr. Baker speaks internationally on the topics of intellectual property rights, patent reform, markets, business models, standardization and the underlying economic principles, and teaches executive level business courses regarding intellectual property and other issues at various universities. His speaking engagements include conferences hosted by various U.S., Chinese, and European companies, educational institutions, and government bodies interested in IPRs and business related issues. 

 


Dr. Kai BRANDT, Head of Siemens Intellectual Property, Standardization and Environmental Affairs in China.

Dr. Kai Brandt currently leads Siemens' Intellectual Property, Standardization and environmental activities in China.
He has extensive experience in IPR enforcement, defense and prosecution as well as licensing negotiations. Dr. Brandt also consults the European and German government in his areas of responsibility.

Siemens is one of the world's largest electrical engineering and electronics companies. Siemens provides innovative technologies and comprehensive know-how to benefit customers in 190 countries. The company has approximately 475,000 employees. In fiscal 2006 (ended September 30), Siemens had sales of € 87.325 billion and net income of € 3.033 billion.



Carl CargillCarl Cargill is Sun's Director of Standards, where he manages Sun's standardization strategies, activities, and portfolio.

He has been at this activity (standardization) for nearly twenty five years, and has written two books (_Information Technology Standardization: Theory, Process, and Organizations_ and _Open Systems Standardization: A Business Approach _), multiple chapters in other books on the subject, and the 'Standards' entry in the Van Nostrand Reinhold _Encyclopedia of Computer Science_. He was the Editor-in-Chief of 'StandardView', ACM's journal of Standardization, and has written scores of articles on the subject of standardization and its practical applications. He has testified several times before Congress, and has been on Office of Technology Assessment and General Accounting Office panels as an expert on standardization.

He has served on the Boards of W3C, Object Management Group, Open Mobile Alliance, The Open GIS Consortium, The Open Group, Enterprise Grid Alliance, ECMA, and OSGi. He was the Director of Standards at Netscape, and a standards strategist at both Sun and Digital Equipment Corporation. During the rest of his career, has was a product strategist, marketing manager, pricing manager, program manager , and was, at one time, an Air Force intelligence officer.
His interests include Medieval History and the study of magic (as distinguished from quantum mechanics). He holds a BA from the University of Colorado in Medieval European History (1969) and a Masters in the Science of Administration (Management Engineering) from the George Washington University (1975).




Bill DaviesWilliam A. DAVIES, General Manager and President, Research in Motion International SRL 

Born in Argentina of an Irish Argentine family, he was raised in Brazil and educated in the United States. He speaks English, Spanish and Portuguese. He graduated from Purdue University in Economics and has a Degree of JD, cum laude, from Indiana University School of Law.

During his professional life, William A. Davies has worked for a variety of private sector enterprises.

After service in the United States Army he became a Reinsurance Representative of Lincoln National Life Insurance Company with responsibility for Latin America and the Caribbean, it is here that his interest in working with Governments for the benefit of private enterprise was developed as the Life Reinsurance business is highly regulated and a significant part of servicing the Life Insurance company clients was lobbying government on their behalf.

He then pursued a legal career; First with Cahill Gordon Reindhel & Ohl a Wall Street law firm where he had the good fortune to work closely with the former legal adviser to the US State Department who was then a senior partner at the firm; Second with Motorola Inc. where he held successively positions of responsibility advising the business sectors. This included 5 years in Geneva Switzerland where he was very active with the fledgling European Commission in the lobbying of the necessary rules for the Common Market while not hindering the conduct of business.

He served as Vice President and Assistant General Counsel and then as VP and Director of Technology Transfer. He also was the founder and architect of the Motorola Government Relations Team for Latin America, which he successfully led for 6 years.

He then became a Senior Principal for the professional services firm of DeLevante y Asociados, Panama, R.P. where he consulted for clients throughout the Americas on spectrum, telecommunications and standards issues. He is currently a General Manager and President of Research in Motion (Barbados) Ltd. His current assignment is to champion RIM's efforts to reform of the IPR laws.

During his career Davies has served on the Board of Standards Review of the American National Standards Institute, The Joint Government Private Committee of Experts on Electronic Commerce of the FTAA, and the Board of Trustees of Latin American Young Executives, he has been a member of the Argentine, Venezuelan and Canadian Delegations to the CITEL Permanent Consultative Committees I and II (formerly III), and has been a frequent speaker at industry Fora.




Michael FroehlichDr. Michael FROEHLICH, is the Legal Affairs Director at the European Telecommunications Standards Institute (ETSI).

Michael Fröhlich is registered with the German Bar and has a Ph.D. in Copyright (2000). He was educated at the Universität des Saarlandes (1st German State Examination, 1995), the Université de Montpellier (Diplôme d'Etudes Approfondies, 1996) and the Kammergericht Berlin (2nd German State Examination 2001).

Michael Fröhlich has practised as an Attorney at Law for several years at the Düsseldorf office of Preu Bohlig & Partner in the fields of contentious and pre-contentious infringement matters in all areas of Intellectual Property Rights, with a particular focus on patents. In this function he has represented various clients from technology-driven industries and acquired significant experience in domestic and cross-border patent infringement litigation. Michael Fröhlich shows also work experience in Brasil, where he was active for the IP-specialised law firm Dannemann Siemsen Bigler & Ipanema Moreira.

In his current role he is advising the ETSI membership and the ETSI Secretariat staff on legal issues with a main emphasis on IPRs and Standardisation. He has actively participated and contributed to the work of the recent ETSI IPR Review ad hoc group (IPR R AHG) and was in charge of the implementation of the recommendations of the IPR R AHG into the ETSI Bylaws. 




Jack HAKEN is Vice President of Intellectual Property and Standards at Koninklijke Philips Electronics N.V. (Royal Philips Electronics)

Mr. Haken joined Philips in 1977. During his service his responsibilities have included patent procurement, licensing and litigation management in the fields of telecommunications, medical imaging, audio's video coding, lighting and semiconductor devices. He has more than twenty years experience managing licensing programs and related activities in Japan, Korea, Taiwan and China. Mr. Haken briefed and argued a number of seminal cases before the U.S. Court of Appeals for the Federal Circuit that helped to define the modern standards for patentability of software.

Mr. Haken holds B.EE and M. Eng. degrees from Rensselaer Polytechnic Institute and a J.D. from Union University Albany Law School. He is admitted to the New York and Federal Bar and to practice before the United States Patent and Trademark Office.

Mr. Haken is a member of the Board of Directors of the Intellectual Property Owners Association (IPO).
From 2005 -2007 Mr. Haken has served as visiting professor at the Philips IP Academies at Tsinghua University Law School in Beijing and at Fudan University Law School in Shanghai and on the faculty of the George Washington University India Projects.



Konstantinos Karachalios, European Patent Office
 
Konstantinos Karachalios holds a PhD in nuclear reactor safety and before joining the EPO was project leader and co-ordinator for co-operation between France and Germany on the prediction and simulation of large-scale accidents in nuclear plants.
He has been at the EPO since 1987, working as an examiner and on the restructuring of sales administration at the EPO's Vienna sub-office. Between 1999 and 2000 he was head of the International Academy. Since then he has worked on co-operation programmes for developing countries and is in charge of relations with international and intergovernmental organisations. He was member of the core task force of the EPO's Scenarios for the Future project and co-editor of its Compendium. 
 



Dr. Ping LIN, Head & Professor of Economics at Lingnan University of Hong Kong

Dr. Ping Lin, educated at the Chinese Academy of Social Sciences (Graduate School, MA., 1985) and The University of Minnesota (Ph.D., 1993), is Professor of Economics at Lingnan University of Hong Kong and Chair Professor of Economics at Shandong University, China. He is also a research fellow at the Center for Public Policy Studies at Lingnan University. Dr. Lin taught at Southern Methodist University in the United States and has been with Lingnan since 1997. His research interests are centered on industrial organization, competition laws/policy, the economics of innovation, and FDI and technology transfer. His publications have appeared in the Journal of Industrial Economics, International Journal of Industrial Organization, Review of Industrial Organization, European Economic Review, Journal of Economic Theory, Journal of International Economics, Oxford Economic Papers, and other academic journals. Dr. Lin teaches industrial organization, competition policy and regulation, game theory, among other courses. His translated book The Antitrust Revolution: Economics, Competition, and Policy (John E. Kwoka, Jr. and Lawrence J. White, 4th edition) will be in print in Chinese in late 2007.

Dr. Lin has provided consultancy work to Asian Development Bank, the International Bar Association, OECD, the State Council of PRC, and Hong Kong Special Administration Region (SAR) Government. He is a founding Academic Board member of Asian
Competition Forum, and Vice-President of Hong Kong Economic Association. He has been appointed by the Chief Executive of Hong Kong as a member of the Telecommunications (Competition Provisions) Appeal Board from August 2007 to July 2009.



LUO, Li is an associate professor at China University of Political Science and Law, Beijing, China.

She obtained her LL.B. LL.M. and Ph.D from China University of Political Science and Law in 1993, 1996 and 2001 respectively. In 2003, she earned a Dr. jur. from Universität zu Köln, magna cum laude.
In 1996, LUO Li became a faculty member of the Department of Economic Law, China University of Political Science and Law. She taught corporate law for three years before she pursued her studies in Germany. At the Universität zu Köln, she became very interested in intellectual property law, especially internet related copyright issues. She was awarded a fellowship as a Hauser Global Research Fellow at New York University School of Law for 2004-2005. Prior to her fellowship at NYU, she served as an adjunct professor at College of Staten Island, the City University of New York for one semester.

LUO, Li focuses her research on mainly intellectual property law and corporate law. Her publications include: Verwertungsrechte und Verwertungsschutz im Internet nach neuem Urheberrecht (C.H. Amy A. MARASCO, General Manager, Standards Strategy, Microsoft Corporation

Amy is the General Manager for Standards Strategy at Microsoft, and she leads a team that addresses strategic policy and engagement issues on a corporate-wide, global basis.  Amy joined Microsoft after serving as the Vice President and General Counsel of the American National Standards Institute (ANSI) from 1994-2004.  Amy regularly engages in standards-related intellectual property policy debates in many forums, and she serves on the Board of Directors of ANSI and TIA.

Prior to joining ANSI, Amy was an attorney for ten years with the law firm of Cadwalader, Wickersham & Taft in its New York office.



Karsten MeinholdKarsten Meinhold, Nokia Siemens Networks

After study of Physics Karsten Meinhold joined Siemens AG in 1973, which was changed to Nokia Siemens Networks in 2007.
Karsten worked in different functions, including technical development, strategy planning, standards policy.
Karsten held chairmanship in several associations :
ETSI General Assembly vicechairman from 1998 to 2002, ETSI General Assembly Chairman from 2002 to 2006
Chairman of ETSI IPR review activity in 2005 and 2006 and Chairman of ETSI IPR Committee appointed November 2006 for a two year term.



Ni Guang NanNi, Guang Nan , Chinese Academy of Sciences

Mr. Guangnan Ni is the Academician of Chinese Academy of Engineering and the Professor of Institute of Computing Technology, Chinese Academy of Sciences.
He had been working in computer field over past four decades. In 1960&acric;€™s he had participated in the R&D of the first Computer designed by China own. In 1984-1995 he was the cofounder and CTO of Legend Group Co. (renamed as Lenova recently). Under his leadership the Legend Chinese Card and Legend Series PC were developed and formed the core business of the company. Both products got the first-class prize of the State Award for Scientific and Technological Achievement in 1988 and 1992 respectively. In recent years he has been devoting in promotion of Linux and the domestic software. Since 2002 he is in charge of the president of Chinese Information Processing Society of China.




Earl NIED is the Program Director of Standards and Industry Groups for Intel Corporation's Legal and Corporate Affairs Group.

Earl is responsible for the coordination of Intel's world wide Legal teams on standards and industry group issues.  He is an active participant in the American National Standards Institute (ANSI) Intellectual Property Rights Policy Committee and chairs the ANSI Patent Group; he is an active participant in the International Telecommunications Union Telecommunication Standardization Sector IPR Ad Hoc Committee and the European Telecommunications Standards Institute (ETSI); he participated in the World Wide Web Consortium (W3C) Patent Policy Working Group in the formation of the current W3C patent policy and is currently on the W3C Patents and Standards Interest Group; and has been involved in several other international organizations and IPR committees.  In addition, Earl has been a consultant to several international standards development organizations including the Audio Video Coding Standard Workgroup of China (AVS) and the China Electronics Standardization Institute (CESI).

Feng PANFeng PAN currently holds the positions of Director of Technical Coordination Department of Telecommunication Standard of MII and Assistant Secretary-general of China Communications Standards Association.

Since the graduation from Beijing University of Posts and Telecommunications in 1985, she has been engaged in the research and management work on communications standards and policies all the time, and has participated in the drafting work of some standards and policies. She took positions in succession as Deputy Director of The Research Institute of Telecommunications Transmission of Ministry of Posts and Telecommunications(former name of MII), Director of Technology & Foreign Affairs Division of China Academy of Telecommunications Research of MII. She currently holds the positions of Director of Technical Coordination Department of Telecommunication Standard of MII and the Assistant Secretary-general of China Communications Standards Association.



Heinz PolstererHeinz Polsterer, T-Mobile International Austria, Executive Vice President, International Standardization & IPR Management

Heinz Polsterer has been with T-Mobile. since 1996, initially as Project Manager for Prepaid and IN Services. He was appointed Executive Vice President of Systems Engineering in 1997, dealing with the technical strategic planning and implementing of new services. In 2002 Heinz Polsterer changed from T-Mobile Austria to T-Mobile International becoming responsible for all standardization activities within T-Mobile. This area of responsibility was extended to IPR Management two years later.
Heinz Polsterer is very active in ETSI and NGMN to improve the IPR regime in standardization.

Mr. Polsterer graduated from the Technical College in St. Pölten with a Technical degree (Telecommunication) in 1985 followed by a graduation from the University of Vienna with a Technical degree (Informatics) in 1992.
His career spans 21 years experience in Telecommunications and Informatics with a Manufacturer and T-Mobile.


Michael PulchDr. Michael Pulch, Deputy head of the EU Delegation to China and Mongolia

Dr. Michael Pulch is the Deputy Head of the European Commission Delegation to China and Mongolia in Beijing. He has 20 years working experience in field of international political and economic affairs holding several high level positions such as the Deputy Head of the Economic Section in the German Embassy in Washington DC, USA, the Head of Trade and Commerce Section for the Delegation of the European Commission and the Deputy Head of Unit for Japan and Korea for the Directorate General for External Relations in Brussels. Michael Pulch holds a PhD in comparative public law from the University of Bonn. In 1985, he was awarded a Master of Law in International Law from the University of Cambridge. He received a Diplôme supérieur from the University of Paris II. He graduated with a distinction in law from the University of Bonn.




Shi ShaohuaShi SHAOHUA is an engineer of China Electronics Standardization Institute.

She is responsible for the research on standardization, innovation and intellectual property rights. Shi Shaohua is an active participant both in the development of National Intellectual Property Strategy and in the Chinese proposal 'the IPR Issues in Standardization' to WTO/TBT; she is responsible for the development of CESI IT SDO IPR Policy Template.
Shi Shaohua published several papers about standardization and intellectual property rights.




Professor Wang Bing, full Professor and Director of the Research Center for Intellectual Property Laws, Tsinghua University, Beijing, China.

He graduated from the Department of Chemical Engineering, Tsinghua University in 1970. He had studied intellectual property laws and practice for one year as visiting scholar in Gowling, Strathy & Henderson and the Law School of the University of Ottawa, Ottawa, Canada in 1985. He had been as a visiting professor for near one year in the Department of Chemical Engineering, Ohio State University, U.S.A. in 1993. From the July of 2000 to the July of 2001 he had studied intellectual property laws for one year in Franklin Pierce Law Center, USA and obtained LLM Degree in IP Law.

Professor Bing Wang has been involved in IP management, IP education and research of intellectual property laws. He had been responsible for the management and legal affairs in the R & D collaborations between Tsinghua University and industry, particularly foreign companies from 1989 to 1999. He has been engaged in IP education and research since 1995 in School of Law, Tsinghua University. He had been Vice-Dean of the School of Law, Tsinghau University. He has published 4 books and more than 70 papers and conducted 14 IP research projects totally. 



Mr. Wu Xiaoming, Deputy Secretary-General of the National IP Strategy Formulation Leading Group Office (NIPSO); Deputy Director-General of the Development and Research Centre of the State Intellectual Property Office of the People’s Republic of China (SIPO)

Wu Xiaoming has worked over ten years as a patent examiner in the State Intellectual Property Office, He was the Deputy Chief of General Affairs Office of the Examination Department, Chief of Research Office. He currently holds the positions of Deputy Secretary General of the National Intellectual Property Strategy Formulation Leading Group Office and Deputy Director of the State Intellectual Property Development and Research Centre,

He has been in charge of key research projects of the “Twentieth Five Year Plan” entrusted by the Ministry of Science and Technology: Research on Patent development strategy in Diary industry, Research on Strategy of Patent on water-saving technology in agricultural industry, Research on Semi-conductor Light Patent Strategy in China. He has participated in the research on the impacts of the implementation of the TRIPS-Agreement on Chinese pharmaceutical products and related policy, research project of SIPO on the Challenges and Opportunities of China’s IPR after accession into WTO and the countermeasures as well as the Statistical research of the patents owned by 500 foreign enterprises in China and its impacts.




Yang LincunYang Lincun, Director General of Intellectual Property Affairs Center of Ministry of Science and Technology of PRC

Mr. Yang served as the Deputy Director General of Dept. of Policy Making and Legislation of State Science and Technology Commission of PRC. He has rich experience on policy-making and formulation of legislation. Currently he is the Director General of Intellectual Property Affairs Center of Ministry of Science and Technology in charge of research on the protection and administration of intellectual property. He has undertaken the Research on the State Intellectual Property Rights Management and Protection Strategy entrusted under the National 863 Programme and has contributed to a few research programmes on IPR.
He has played a leading role in handling more than 200 cases of technical appraisal entrusted by judicial departments. He has also provided consultation for enterprises and institutions as well as consultation in law aspects for projects under important national programs such as National 863 Program.


Yue Ya - TD-SCDMAYue Ya, Legal Counsel, TD-SCDMA Industry Alliance
He is holding a Certificate of Lawyer as well as a certificate of Patent Attorney and has been working since April 2007 as Legal Counsel for the TD-SCDMA Industry Alliance. In this function, he is in charge of the drafting of the IPR rules of the TDIA, resolving patent license issues amongst members or non-members entities of the TDIA, reviewing their inner agreements as well as the handling of legal issues of TDIA.
Prior to this work at the TDIA, he was manager of the IPR Dept. of Huawei Technologies Co., Ltd, for seven years. During this time, he has gained experience in IPR-licensing negociations, patent applications, patent analysis, co-ordination of government relation, management of the external attorney resource as well as participating in DSO-activities, especially in the field of Communication Services, Wireless Infrastructure Equipment, and Wireless Terminal.


Zang PingProfessor Zhang Ping, Professor of law at Peking University and Director of Internet Law Center of Peking University.

Professor Zhang Ping has been teaching and researching intellectual property law at Law School of Peking University since 1991. She has also been the Secretary General of Universities Intellectual Property Association of China since 1998, Arbitrators of the Asian Domain Name Dispute Resolution Center (ADNDRC) and the Beijing Arbitration Commission, etc.

Her research areas include the Intellectual Property Law, E-Commerce Law and Internet Law. She has undertaking many key research programmes of the state and government ministries as leading expert.
